In these terms and conditions, the following terms have the following meanings:
- Reflection period: The period within which the consumer can make use of his right of withdrawal;
- Consumer: the natural person who is not acting for purposes related to his trade, business, craft or profession;
- Day: calendar day;
- Digital Content: data that is produced and supplied in digital form;
- Contract for an indefinite period of time: a contract that provides for the regular delivery of goods, services and/or digital content for a specific period of time;
- Durable data carrier: every tool - including e-mail - that enables the consumer or Karma Mama to store information that is addressed to him/her personally, in a way that allows for future consultation or use for a period of time that is geared to the purpose for which the information is intended, and that allows for the unaltered reproduction of the stored information;
- Right of withdrawal: the option for the consumer to waive the distance contract within the cooling-off period;
- Karma Mama: the legal entity that offers products, (access to) digital content and/or services to consumers from a distance;
- Distance agreement: an agreement that is concluded between Karma Mama and the consumer within the framework of an organized system for distance selling of products, digital content and/or services, whereby, up to and including the moment the agreement is concluded, sole or joint use is made of one or more techniques for distance communication;
- Technique for distance communication: means that can be used for concluding an agreement, without the consumer and entrepreneur having to come together in the same room at the same time.

Article 3 - Applicability
- These General Terms and Conditions apply to the webshop of Karma Mama, to every offer made by Karma Mama and to every distance contract that is drawn up between Karma Mama and the consumer.
- Before the distance contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, Karma Mama will indicate, before the distance agreement is concluded, in which way the general terms and conditions can be consulted at the entrepreneur and that they will be sent free of charge at the consumer's request as soon as possible .
- If the distance contract is concluded electronically, then, contrary to the previous paragraph, and before the distance contract is concluded, the text of these general terms and conditions may be made available to the consumer electronically in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, before the agreement at a distance is concluded, it shall be indicated where the general conditions can be consulted electronically and that they will be sent to the consumer free of charge, at his request, either electronically or in some other way.
Article 4 - The sacrifice
- If an offer has a limited period of validity or is made subject to conditions, this shall be explicitly stated in the offer.
- The offer contains a complete and accurate description of the products, digital content and/or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If Karma Mama makes use of images, these are a true representation of the offered products, services and/or digital content. Obvious mistakes or obvious errors in the offering do not bind Karma Mama.
- Each offer contains such information that it is clear to the consumer what rights and obligations are attached to accepting the offer.
Article 5 - The agreement
- The agreement is concluded, subject to that which is stated in paragraph 4, at the moment the consumer accepts the offer and fulfills the conditions attached to it.
- If the consumer has accepted the offer electronically, Karma Mama will immediately confirm receipt of electronic acceptance of the offer. As long as the receipt of this acceptance has not been confirmed by Karma Mama, the consumer may terminate the agreement.
- If the agreement is realized electronically, Karma Mama will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a safe web environment. If the consumer can pay electronically, Karma Mama will take appropriate safety measures.
- The entrepreneur may - within legal limits - inform the consumer about his/her ability to fulfill his/her payment obligations, as well as about all those facts and factors that are important for a responsible conclusion of the distance contract. If, on the basis of this investigation, Karma Mama has good grounds for not entering into the agreement, it is entitled to refuse an order or request while giving reasons, or to attach special conditions to the execution.
- No later than at the delivery of the product, service or digital content, Karma Mama will send the consumer the following information, in writing or in such a way that the consumer can store it in an accessible way on a durable data carrier:
- a. the contact details of Karma Mama where the consumer can go for complaints;
- b. the conditions under which and the way in which the Consumer may exercise the right of withdrawal, or a clear statement concerning the exclusion of the right of withdrawal;
- c. the information on guarantees and existing after-sales service;
- d. the price, including all taxes, of the product, service or digital content; where applicable, the costs of delivery; and the method of payment, delivery or performance of the distance contract
- e. the requirements for canceling the agreement if the agreement has a duration of more than one year or is indefinite;
- In the event of a long-term transaction, the provision in the previous paragraph shall apply only to the first delivery.
Article 6 - Right of withdrawal
- When purchasing products, the consumer has the option of dissolving the agreement without giving reasons for a period of 14 days. Karma Mama may ask the consumer for the reason for cancellation, but may not oblige the consumer to state his/her reason(s).
- The cooling-off period referred to in paragraph 1 commences on the day after the consumer, or a third party appointed by the consumer in advance, who is not the carrier, has received the product.
Article 7 - Obligations of the consumer during the reflection period
- During the reflection period the consumer will handle the product and packaging with care. He will keep the product in its original state and will only unpack or use the product to the extent necessary to judge whether he wishes to keep the product.
- The consumer is only responsible for decrease in value of the product that is the result of a way of handling the product that goes beyond what is allowed in paragraph 1.
- The consumer is not liable for a reduction in value of the product if the entrepreneur has not provided him with all legally required information about the right of withdrawal before or at the time of concluding the contract.
Article 8 - Exercise of the consumer's right of withdrawal and costs
- If the consumer wishes to exercise his/her right of withdrawal, he/she must notify Karma Mama within the cooling-off period.
- The consumer will return the product as soon as possible, but within 14 days of the day following the notification referred to in paragraph 1.
- The consumer will return the product with all delivered accessories, if reasonably possible in the original state and packaging, and in accordance with the reasonable and clear instructions provided by Karma Mama.
- The risk and burden of proof of the correct and timely exercise of the right of withdrawal lies with the consumer.
- The consumer bears the direct costs of returning the product. If Karma Mama has indicated that the consumer should bear these costs or if the entrepreneur has indicated to bear the costs himself, the consumer does not have to bear the costs of return shipment.
Article 9 - Exclusion of right of withdrawal
Karma Mama can exclude products from the right of withdrawal, but only if Karma Mama has clearly mentioned this in the offer, or at least in good time before concluding the agreement:
- Products or services of which the price is linked to fluctuations on the financial market over which Karma Mama has no influence and which can occur within the withdrawal period;
- Agreements concerning leisure activities, if a certain date or period of execution of the agreement is provided for;
- Products that have a limited expiry date;
- Sealed products that are not suitable to be returned for reasons of health protection or hygiene and of which the seal has been broken after delivery;
Article 10 - The price
- The price of all products is as stated on the website of Karma Mama. The prices mentioned on the website are subject to printing and typing errors. Karma Mama accepts no liability for the consequences of misprints and typesetting errors. The prices shown may be modified prior to or after the purchase process, if it appears that the prices are incorrectly stated.
- Unless stated otherwise, these prices are exclusive of delivery and payment costs, which will be added to the total amount due. All prices include 21% VAT (The Netherlands). International orders are subject to and may be subject to taxes and duties as determined by customs in the country of destination. Payment of any duties and taxes is the responsibility of the recipient.
- During the period of validity stated in the offer, the prices of the products and/or services offered shall not be increased, subject to price changes resulting from changes in VAT rates.
- Contrary to the previous paragraph, Karma Mama can offer products or services of which the prices are linked to fluctuations on the financial market and on which the entrepreneur has no influence, with variable prices without prior notification of this price change.
- When the consumer buys a product during a period in which no action applies, he is not eligible for a discount afterwards.
Article 11 - Compliance and warranty
- Karma Mama guarantees that the products and/or services comply with the agreement, with the specifications stated in the offer, with the reasonable requirements of soundness and/or usability and with the existing statutory provisions and/or government regulations on the date the agreement was made. If agreed, Karma Mama also guarantees that the product is suitable for normal use.
Article 12 - Delivery and execution
- Karma Mama will take the greatest possible care when receiving and carrying out orders for products.
- The place of delivery is the address made known to Karma Mama by the consumer.
- With due observance of that which is stated in Article 4 of these terms and conditions, Karma Mama will carry out accepted orders with due haste but at the latest within 30 days, unless a different delivery period has been agreed. If the delivery is delayed, or if an order cannot be carried out in full or in part, the consumer will be informed of this within 30 days of placing the order. The consumer in that case has the right to terminate the agreement without costs and the right to possible compensation.
- After termination in accordance with the previous paragraph, Karma Mama will refund the amount paid by the consumer as soon as possible, but in any case within 30 days.
- The risk of damage and/or loss of products remains with Karma Mama up to the moment of delivery to the consumer.
Article 13 - Complaints
- Complaints about a product or compliance with this agreement must be made to Karma Mama as soon as possible after the consumer has discovered the defects, fully and clearly described, via hello@karma-mama.com.
- Complaints submitted to the entrepreneur will be answered within a period of 14 days, calculated from the date of receipt. If a complaint requires a foreseeably longer processing time, Karma Mama will respond within 14 days with a notice of receipt and an indication of when the consumer can expect a more detailed answer.
- The consumer must give Karma Mama at least 4 weeks time to resolve the complaint in mutual consultation.
Article 14 - Disputes
- The agreement between Karma Mama and the consumer to which these General Terms and Conditions apply is exclusively governed by Dutch law.
